
Damian Biondo is an intellectual property attorney with over two decades of experience advising clients on patent, trademark, copyright, and trade secret matters. He counsels innovators, artists, creators, entrepreneurs, and businesses large and small on the development, protection, and strategic use of intellectual property assets.
Prior to joining Wilftek, Damian served as in-house intellectual property counsel to a startup technology company in the human-fatigue management industry. In that role, he designed and implemented the company’s invention harvesting pipeline and overall patent strategy, drafting and prosecuting patent applications involving software systems, data-driven platforms, and machine-learning-based technologies. The company’s technologies were deployed in highly regulated and mission-critical environments, including use by government agencies such as NASA, the Federal Aviation Administration (FAA), the U.S. Army, and the Office of Naval Intelligence (ONI). His work required navigating the complex regulatory frameworks governing technology developed and deployed in government contracting environments, including compliance with the Federal Acquisition Regulations (FAR), Defense Federal Acquisition Regulations (DFAR), and the Bayh-Dole Act. In addition, he negotiated and structured intellectual property rights frameworks for collaborative research and technology development initiatives involving multiple Class IV research institutions, balancing regulatory compliance, commercialization strategy, and the often-complex realities of multi-stakeholder institutional dynamics.
Damian has advised clients on patent strategy, IP enforcement options, and intellectual property portfolio development, and has contributed to complex intellectual property disputes. His law firm experience includes patent drafting and prosecution work at intellectual property boutiques, as well as advisory work involving portfolio strategy and post-grant proceedings. He began his legal career as an associate at an AmLaw 50 firm in New York, where he worked on ultra-high-stakes international patent litigation.
Damian advises clients on emerging legal, regulatory, and governance issues involving artificial intelligence, data governance, and technology-driven innovation. He also regularly advises small businesses, startups, and early-stage innovators on cost-effective trademark protection, brand strategy, and foundational intellectual property planning, including the strategic use of provisional patent applications and the development of cost-aware patent, trademark, and IP strategies grounded in data-driven analysis and marketplace realities.
In addition to his practice, Damian has taught intellectual property as a Visiting Professor at Southern University Law Center. He is a frequent CLE presenter on patent eligibility, software patenting, and intellectual property strategy.
Damian also has a long-standing record of providing pro-bono legal services to artists, musicians, and other creatives through Philadelphia Volunteer Lawyers for the Arts spanning more than two decades.
Damian holds a J.D. from Georgetown University Law Center, a B.S. in Computer Science from the University of Maryland, and a B.A. in Philosophy from the University of California, Santa Cruz. He is registered to practice before the U.S. Patent and Trademark Office and is licensed in Pennsylvania.
